  • Economic Damages. Economic damages represent your quantifiable, out-of-pocket losses arising from a defendant’s wrongful conduct. This commonly includes your past, present, and estimated future medical expenses, as well as any loss of income or earning capacity. In some cases economic damages may also cover property-related losses, such as the cost of fixing or replacing your car if it was involved in an accident. There is no limit to the amount of economic damages you may receive under California law.
  • Non-Economic Damages. Some damages clearly exist yet cannot be precisely quantified. For example, accident victims often incur a significant amount of pain and suffering that can last for years. Non-economic damages are designed to compensate victims for such emotional trauma. In most cases, California law does not limit non-economic damages, although there are certain exceptions, such as cases involving medical malpractice.
  • Punitive Damages. Unlike economic and non-economic damages, punitive damages are meant to punish egregious misconduct by a person or company. Most California personal injury claims do not involve punitive damages, as it requires more than proof of simple negligence. Punitive damages are only permitted when the defendant’s conduct amounted to “malice, oppression, or fraud.” Still, when punitive damages are available they can often be quite substantial.

In addition to these damages, if a victim dies as the result of negligent conduct, their estate and next-of-kin may file a wrongful death lawsuit against the responsible parties. A wrongful death claim allows family members to recover damages for the loss of the victim’s income, household services, and companionship. The victim’s estate may also cover certain expenses.
