Damages in a Car Accident Case in Orange County

Many people who are injured in car accidents start the process of seeking compensation by filing an auto insurance claim. With an auto insurance claim, you may be able to obtain a settlement from the insurance company. Yet in many circumstances, an insurance settlement is insufficient to cover losses and an injured person files a lawsuit against the at-fault party or parties.

In a lawsuit, the injured person can be eligible to obtain compensatory damages. There are two types of compensatory damages. Both kinds of compensatory damages are intended to compensate the plaintiff for different types of losses. Under California law, those types of compensatory damages include:

  • Economic damages, which refer to “objectively verifiable monetary losses including medical expenses, loss of earnings, burial costs, loss of use of property, costs of repair or replacement, costs of obtaining substitute domestic services, loss of employment, and loss of business or employment opportunities”; and
  • Non-economic damages, which refer to “subjective, non-monetary losses including, but not limited to, pain, suffering, inconvenience, mental suffering, emotional distress, loss of society and companionship, loss of consortium, injury to reputation, and humiliation.”

Orange County Car Accident Statute of Limitations

Most car accident lawsuits in California will need to be filed within two years from the date of your accident, according to California law. It is important to remember that the statute of limitations refers to the clock on your lawsuit rather than a clock on your auto insurance claim. However, even if an auto insurance claim takes a significant amount of time, you will still be required to file your lawsuit before the statute of limitations runs out. To be clear, filing an auto insurance claim first will not pause the clock on the statute of limitations.

If there is a possibility that you may need to file a government claim — such as a claim against a government employee who caused the accident and was on the clock while driving, or a claim against a city or municipality due to a failure to maintain the road in a safe condition — your time window may be significantly shorter. In such cases, it may be necessary to file a claim in either six months or one year from the date of the accident. You should check with a lawyer as soon as possible to ensure that you have time to file a claim and to seek compensation for your losses.
